Terms of Use

These Terms of Use ("Terms") govern your access to and use of the AITRUNK platform, including the API, CLI, MCP server, web portal, and all related services (collectively, the "Service"), operated by SipPulse Tecnologia Ltda. ("SipPulse", "we", "us", or "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and have the legal capacity to enter into contracts. If you use the Service on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

2. Account Registration

  • You must provide accurate, current, and complete information during registration.
  • You are responsible for safeguarding your API keys and account credentials.
  • You are fully responsible for all activity that occurs under your account, including calls made by AI agents using your credentials.
  • You must notify us immediately if you suspect unauthorized use of your account.

3. Acceptable Use

You may use the Service to originate legitimate telephone calls through AI agents, CLI commands, or MCP tools. You agree to comply with all applicable laws and regulations, including telecommunications laws, consumer protection laws, and anti-spam regulations.

4. Prohibited Activities

ZERO TOLERANCE POLICY. AITRUNK enforces an absolute zero-tolerance policy for fraudulent, abusive, or illegal use. Violations result in immediate and permanent account termination, forfeiture of all credits, and referral to law enforcement authorities.

The following activities are strictly prohibited:

4.1 Fraud and Deception

  • Caller-ID spoofing — using the Service to display a false or misleading caller-ID, or to impersonate another person, company, or government entity.
  • Vishing (voice phishing) — using AI agents to deceive call recipients into disclosing personal information, financial data, passwords, or any sensitive information under false pretenses.
  • Impersonation — programming AI agents to present themselves as banks, government agencies, law enforcement, healthcare providers, or any entity they do not represent.
  • Scam calls — originating calls that promote fraudulent schemes, fake prizes, bogus debt collection, or any form of financial fraud.
  • Social engineering — using AI agents to manipulate recipients into performing actions against their interest through deception.

4.2 Harassment and Abuse

  • Robocalling — making unsolicited automated calls in violation of applicable do-not-call regulations (including but not limited to TCPA, LGPD, and local equivalents).
  • Harassment — repeated calls to recipients who have requested not to be contacted, or calls made with the intent to annoy, abuse, threaten, or intimidate.
  • Excessive calling — placing an unreasonable volume of calls to the same recipient or phone number within a short period.
  • Threats or coercion — using AI agents to threaten, extort, blackmail, or coerce recipients in any manner.

4.3 Illegal Content and Activities

  • Calls promoting illegal products, services, or activities.
  • Calls that violate intellectual property rights.
  • Calls that distribute malware, phishing links, or fraudulent URLs via TTS.
  • Using the Service to facilitate money laundering, terrorism financing, or any activity sanctioned by international law.
  • Calling emergency numbers (911, 190, 192, or equivalents) through the Service.

4.4 Technical Abuse

  • Attempting to bypass credit limits, rate limits, or security controls.
  • Reverse engineering, decompiling, or attempting to extract source code from the Service.
  • Using the Service to conduct traffic pumping, toll fraud, or Wangiri schemes.
  • Sharing, reselling, or sublicensing API keys or account access without authorization.
  • Generating artificial traffic to inflate CDRs or manipulate billing.

5. Monitoring and Enforcement

  • All calls placed through the Service are subject to automated monitoring using AI-based fraud detection systems.
  • We reserve the right to suspend or terminate your account immediately, without prior notice, if we detect or reasonably suspect any prohibited activity.
  • We may review call metadata, context variables, TTS text, and agent configurations to investigate potential violations.
  • We cooperate fully with law enforcement agencies and will provide call records, account information, and any other relevant data in response to valid legal requests.
  • Suspended accounts are not entitled to refunds of unused credits.

6. Credit System and Billing

  • The Service operates on a prepaid credit system. Credits are consumed per minute based on call type.
  • Credit rates and plan details are published on our website and may change with 30 days notice.
  • Unused credits do not roll over between billing periods unless otherwise specified in your plan.
  • All payments are processed through Stripe. We do not store credit card information.
  • Refunds are available within 7 days of purchase for unused credits only, except for accounts terminated for policy violations.
  • Credits forfeited due to account termination for prohibited activities are non-refundable.

7. Phone Numbers (DIDs)

  • Phone numbers assigned to your account remain the property of SipPulse and our upstream carriers.
  • Numbers may be reclaimed if your account is inactive for 90 consecutive days or upon account termination.
  • You may not use assigned numbers for purposes unrelated to the Service.

8. Service Availability

We strive for high availability but do not guarantee uninterrupted service. The Service depends on third-party telecommunications carriers, and call completion rates may vary by destination. We are not liable for failed calls due to carrier issues, network congestion, or recipient unavailability.

9. Intellectual Property

The Service, including its source code, documentation, branding (including the Trunky mascot), and all associated materials, is the property of SipPulse. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

10. Limitation of Liability

To the maximum extent permitted by law, SipPulse shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless SipPulse, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Modifications

We may update these Terms at any time. Material changes will be communicated via email or through the portal at least 30 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of Brazil. Any disputes shall be resolved in the courts of the city of Florianópolis, State of Santa Catarina, Brazil.
